Terms of service
By installing or using Bannerbird you agree to these terms and to our privacy policy. If you use Bannerbird for a business, you agree on its behalf. Shopify's own terms also apply to your store and to apps from the Shopify App Store.
1. What Bannerbird does
Bannerbird lets you show free-shipping, countdown and announcement bars on your Shopify store, and see how they perform. We may improve, change or retire features over time. If we remove something you pay for, we'll tell you first.
2. Plans and billing
- Free costs nothing and has no time limit.
- Pro costs $4.99 a month or $48 a year, in US dollars, and starts with a 14-day free trial. Each store gets one trial: if you cancel and subscribe again, you get only the trial days you hadn't used.
- Shopify bills you for Pro on your Shopify invoice, and Shopify's billing terms apply. We never see your card.
- You can switch plans or uninstall at any time in the app. Billing stops from then on, the way Shopify handles app charges. We don't refund charges already made, except where the law requires it.
- We may change prices with at least 30 days' notice in the app or by email. A new price applies from your next billing period after that.
3. Your responsibilities
- Your bars are yours. You're responsible for what they say: that offers, discount codes and deadlines are true, and that they follow the consumer, advertising and other laws where you sell. Don't use countdowns to invent urgency that isn't real.
- Your shoppers' privacy. Tell your shoppers about the tools your store uses in your own privacy policy, and keep Shopify's cookie consent settings on where the law requires them. Bannerbird follows your shoppers' consent choices.
- Your account. Keep access to your Shopify admin secure, and tell us if you think someone misused Bannerbird through it.
4. What you may not do
Don't use Bannerbird for anything illegal, deceptive or harmful; to send malware or attack our systems or anyone else's; to send fake activity to our servers; or to copy, resell or rebuild the app. We may suspend access if you do, and we'll tell you why unless the law or safety prevents it.
5. Data
Our privacy policy explains what we collect and why. For the data about your shoppers that Bannerbird handles (counts of views and clicks, and order IDs for shoppers who allowed analytics), you're the controller and we're your processor. We'll:
- only use it to run Bannerbird for you, as these terms and the app's settings describe;
- keep it confidential, and only let people who need it, and who are bound to keep it confidential, handle it;
- protect it with appropriate security, including encryption in transit and at rest;
- use only the subprocessors listed in the privacy policy (Shopify, and Cloudflare, which hosts the app), and tell you before adding others;
- tell you without undue delay if a security incident affects it;
- help you answer your shoppers' requests and data protection questions where we can;
- delete it when you uninstall, as described in the privacy policy (48 hours after uninstalling, when Shopify asks us to).
Where the GDPR or similar laws apply, this section is our data processing agreement with you, and the European Commission's standard contractual clauses apply to any transfer of that data out of the EEA, the UK or Switzerland that needs them.
6. Ownership
You keep all rights to your bars, store content and data. You let us store and display them only to run Bannerbird for you. We keep all rights to Bannerbird itself: the app, its code, design, templates and name. If you send us ideas or feedback, we may use them freely.
7. Support and availability
We aim to reply to support emails within 3 business days. We work to keep Bannerbird running and fast, but we can't promise it will always be available or free of errors. Your bars are shown from data saved in your store, so they usually keep showing even if our servers are briefly unavailable.
8. Disclaimers
Bannerbird is provided "as is". We don't promise any particular result, such as more sales or bigger orders. To the extent the law allows, we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.
9. Limits on liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claims about Bannerbird is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing in these terms limits liability that the law doesn't allow us to limit.
10. Claims about your content
If someone makes a claim against us because of your bars or your use of Bannerbird against these terms, you'll cover our reasonable costs of dealing with it.
11. Ending these terms
You can stop at any time by uninstalling Bannerbird. We may end these terms or your access with 30 days' notice, or straight away if you seriously break them. When they end, your bars stop showing and your data is deleted as the privacy policy describes. Sections 6, 8, 9, 10 and 13 continue to apply.
12. Changes to these terms
We may update these terms. For important changes we'll tell you in the app or by email at least 30 days before they apply. If you keep using Bannerbird after that, the new terms apply; if you don't agree, uninstall it.
13. Law and disputes
These terms are governed by the laws of the State of Florida, and disputes go to the state or federal courts in Florida, unless the law where you're based gives you the right to use your local courts.
